Terms and Conditions of the Freebees Program
Valid as of August, 2023. Version 4.3.
Freebees TM Loyalty Program (hereinafter referred to as the “Program”) is provided and operated by Superstar Communications, Inc. (hereinafter referred to as “Superstar Communications”, “us”, “we” and/or “our”).
By enrolling as a Freebees Member (hereinafter referred to as the “Member”), we are providing you a licence to accumulate Freebees TM money by dealing with our Freebees Partners (hereinafter referred to as the “Partner”) and to spend this money against goods or services available from such Partners.
Enrollment, membership, and all related benefits of the Program are offered at our discretion. By enrolling into the Program or accumulating Freebees TM money, you agree that you have read and understood these Terms and Conditions of the Program and are bound by all of them, as amended from time to time, and you consent to our collection and use of your personal information in accordance with our privacy commitment.
I. COMMITTED TO PRIVACY
We are committed to protecting your privacy as well as of our Partners. We collect and use personal information to administer the Program; to record, update, and redeem Freebees TM money balances; to communicate Partners’ information and offers; to understand and analyse your needs and preferences; to market goods and services to meet those needs. If you no longer wish to receive communications or offers and promotions from Partners, we offer you easy solutions to unsubscribe or edit your personal settings.
II. PARTICIPATION IN THE PROGRAM
To become a Member of our Program, you must have a valid mailing/municipal address in Canada and a valid e-mail address, as well as you must be of a legal age in the province in which you reside. If we accept your enrollment application, we will create your Member Account (hereinafter referred to as the “Account”) of the Freebees TM Program. You can download our mobile application or get your membership card at a participating Partner location.
We allocate a single Account per Member. Our Program, which may include Freebees TM money, membership cards, or other relating documents, and all rights hereof, are and will remain our property. You are responsible for all applicable taxes, based on the province in which you reside, as a result of your participation in the Program, including collecting and redeeming Freebees TM money. It is prohibited to transfer, sell, exchange, give or dispose of the Freebees TM money in any way whatsoever, except in accordance with the prescribed conditions and the payment of such fees that may be imposed, from time to time, at our sole discretion.
Note that anyone who knows or have access to your Account number and your Personal Identification Number (hereinafter referred to as the “PIN”) will have full access to your membership Account, and may change or update your personal or any other information, and potentially redeem your Freebees TM money without your knowledge. You are responsible for maintaining the confidentiality of your PIN and all related activities that occur using your PIN. You must notify us of any unauthorized use of your PIN. We are not responsible and cannot be held liable, in any way whatsoever, for any loss arising from your failure to comply with these provisions.
If no Freebees TM money activities is exchanged and posted to your Member Account or redeemed for a period of 12 consecutive months at a Partner, we may archive all Freebees TM Exclusive money recorded in your Account for this Partner, without notice or compensation to you.
As long as you remain active in the program, your Freebees TM money will never expire.
III. MOBILE AND OTHER DEVICES
We currently offer free mobile services to our Members. However, any rates charged by your mobile operator, such as texting, video streaming, roaming charges, etc. are your sole responsibility.
In case you change your mobile phone number or deactivate your mobile account, we recommend you to update your account status within 48 hours to ensure offers and messages intended for you are not sent to someone else.
IV. ACCUMULATE AND SPEND FREEBEES TM MONEY
When you do business with our Partners, you must present your mobile application, membership card or provide your Member account number. Our program gives you the right to accumulate Freebees TM money only from our Partners doing business in Canada.
We will credit your Member Account with Freebees TM money accumulated from authorized Partners with accounts in good standing, and only after such Partner has completed and approved the transaction. We cannot be held responsible for any delay or if a Partner does not notify us in a timely fashion, or any other delay in the recording of your Freebees TM money in your Member Account.
We may cancel the accumulated Freebees TM money if the Partner with whom you have accumulated these amounts is in default toward the Program or notifies us to cancel such money (if, for example, you have returned or failed to pay for goods or services that you received). Partners, in their sole discretion, will determine how they offer and redeem your accumulated Freebees TM money and may change the Terms and Conditions without notice, from time to time. We and our Partners cannot be held responsible, in any way, shape or form, for any expired Freebees TM money offers. In case of returned merchandise or refund of purchase price, the Partner is entitled to demand reimbursement of the equivalent Freebees TM money already granted to you. If the balance of the Freebees TM money in the Member's Account is insufficient, the Partner may require the balance of the Freebees TM money of such reimbursement in cash money. Any disputes must be settled between you and the Partner.
Upon reimbursement, Freebees TM money is credited to the Member first. For example, if a Member conducts a $30.00 transaction with a Partner and pays $ 25.00 in cash and $ 5.00 in Freebees TM money, then returns a $ 10.00 item, calculation of Partner reimbursement will be as follows: $ 5.00 in Freebees TM money + $ 5.00 cash - $ 0.05 ($ 0.01 per dollar if discount rate is 1%). The Member would thus receive $ 5.00 in cash and $ 4.99 in Freebees TM money for the return of the $ 10.00 item. If Exclusive money was used, this is reimbursed first.
If you believe there is an error in your accumulated Freebees TM money, you must notify us within 60 days of the transaction date for which Freebees TM money were issued, along with supported documentation. Otherwise, your Freebees TM money as recorded in your Member Account will be deemed to be accurate, save and except excess Freebees TM money improperly recorded.
You can accumulate Freebees TM money on your purchases at available participating Partners. Freebees TM money can only be redeemed for goods and services offered by our Partners. A Partner can also decide to add an additional discount in Exclusive money. This can only be used at the Partner who has issued this Exclusive money to the member.
Freebees TM money can’t be converted into cash, but the goods and services offered by our Partners can be purchased using any combination of Freebees TM money and cash.
Partner gives and allocates Freebees TM money on the amount of your transaction before applicable taxes, and will not give nor allocate any Freebees TM money on the amount of transaction paid with Freebees TM money, if any.
In order for the Partner to award Freebees TM money, the amount of the Member’s transaction will be rounded to the closest unit. For example, if the total transaction amount falls between $ 1.01 and $ 1.50, the amount will be rounded to $1.00. At the discount rate of 1%, the Member will receive one $ 0.01 Freebees TM money, for a $ 0.01 value against every dollar spent. If the total transaction amount falls between $ 1.51 and $ 1.99, the amount will be rounded to $2.00. At the discount rate of 1%, the Member will receive two $ 0.02 Freebees TM money.
The Partner undertakes to provide a minimum reward rate of 1% in Exclusive money and shall provide a percentage in Freebees TM money unless it is part of categories with variable reward rates such as gas stations, financial institutions and brokers in mortgage and real estate.
Consumers also have access to purchase Freebees TM money, which they can add directly to their Member account or send them as a gift to a Member or non-member in the form of a prepaid card. A fee applies when purchasing.
The minimum amount to charge is $10.00 and the maximum is $100.00 per card. You can add up to five (5) Partners on the same order.
A secret question must be answered to claim Freebees TM money received by email.
Money must be claimed within a maximum of thirty (30) days. If the money is not claimed within this timeframe, they will be sent back to the buyer’s email address.
Exclusive money can only be used at the Partner who handed them to the member and Freebees TM money can used in all of the national network Partners.
A Partner classified as "issuers only" does not accept payment Freebees TM money.
To avoid fraud and protect Partners and Members, it is impossible to make more than five (5) transactions per day with the same account in the same location.
To avoid errors when manually entering a Freebees Member’s number, we recommend that our Partners scan their customers Freebees Membership card or mobile App using a barcode reader.
By entering manually a Membership number, the Partner is responsible to ensure that the Freebees TM money are assign to the right person. If the Partner makes a mistake by manually entering the membership number, the Partner agrees to compensate the Members with the Freebees TM money not awarded on the transaction if they are requested by the Member.
We also ask that our Partners not proceed to any Freebees transaction with a Member who does not present his Freebees membership card or mobile App.
If a Member wishes to use Freebees TM money to pay part or all of a transaction, the Partner is entitled to demand identification to validate the identity of the person.
In addition, each Partner may determine a maximum amount per transaction. All transactions exceeding this amount will be subject to audit by a representative of our team who will contact the location manager to validate the transaction and whether or not grant the Freebees TM money to the Member.
The transaction is then under verification and Freebees TM money cannot be used until the validation of the transaction is completed. Member will receive an email when the balances are available in the account, if any.
In the event that the Partner refuse the transaction, a verification will also be performed with the Member that will have to present us a receipt of the transaction in question.
If a Member account shows no transaction during twelve (12) consecutive months, the Member will receive a notification. If no Freebees TM money is accumulated or spent in the forty-eight (48) coming hours, the account will be permanently closed and Freebees TM money registered in the account will be considered lost.
The Member can at any time open a new Freebees Member account, but can not recover the lost Freebees TM money.
All goods and services offered in exchange of Freebees TM money are subject to their availability and the terms and conditions imposed by our Partner. We assume no responsibility, in any way, shape or form, for any loss, damage, defect, injury, death or expense caused by the bought and exchanged goods or services or if such goods or services do not meet your expectations for any reason whatsoever.
Unless otherwise indicated, all dollar amounts referred to in these Terms and Conditions are in Canadian dollars, unless otherwise indicated. We only accept payment in lawful money of Canada by way of valid credit card.
Money awarded by the Partners, their offers and Promotions, exclude taxes, tobacco products, gift cards, bottle deposits, fluid dairy products, pharmacy, lottery and any other product where prohibited by law. Some restrictions may apply. See details at Partners.

V. LIMITATION OF LIABILITY
Neither we, our Partners, or our affiliates nor any of our or their respective officers or directors have any responsibility or liability for any expense, loss, cost, injury, damage, delay, accident or any other matter or thing whatsoever (collectively referred to as the “Costs”), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or any damages for loss of income or profits), whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of, related to the Member’s use or participation in the Program. Any liability we may have to you or anyone else who benefits from any redeemed Freebees TM money, under any circumstances, for any negligence, breach of contract or otherwise, is limited to crediting your Member’s Account with the number of Freebees TM money you redeemed in connection with those circumstances. Use of our Internet website is subject to the terms of use displayed thereon from time to time.
WE TRY TO KEEP THE PROGRAM IN A BUG-FREE AND SAFE ENVIRONMENT, BUT ANY USE OF THE PROGRAM IS AT YOUR OWN RISK. WE ARE PROVIDING ACCESS TO THE PROGRAM AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PROGRAM WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT THE PROGRAM WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. THE PROGRAM IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. AS STATED ABOVE, WE WILL NOT BE LIABLE, IN ANY WAY, SHAPE OR FORM, TO YOU FOR ANY LOST PROFITS OR OTHER INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR THE PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE USE OR YOUR PARTICIPATION IN THE PROGRAM EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. THIS LIMITATION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, THE PROGRAM'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
VI. INTELLECTUAL PROPERTY RIGHTS
All right, title, and interest in and to the Program and the mobile application are and will remain our exclusive property. The Program and the mobile application are protected by copyright law, trade-mark law, and other laws of Canada. The Freebees TM names and logo are registered trade-marks of Superstar Communications. You cannot use or display, in any manner whatsoever our trade-name(s), trade-mark(s), service-mark(s), logo(s), design(s), brand feature(s), domain name(s), and other distinctive feature(s), without our prior written consent and permission.
Except as expressly authorized by Superstar Communications, you agree not to modify, copy, alienate, sell, distribute or create derivative works based on the Program, the mobile application, and its content, in whole or in part.
VII. TERMINATION, CHANGES AND BREACH
These Terms and Conditions, or any aspect of the Program including the addition, deletion or change of Partners, suppliers, goods or services, redemption conditions, redemption procedures or any rewards in any respect, are subject to change without further notice, even though if such changes may affect the value of Freebees TM money already accumulated in your Member Account. Any changes will take effect immediately unless otherwise indicated, then, check these Terms and Conditions periodically to examine any subsequent changes. By continuing to use the Program after the publication of such changes, you agree to comply with those changes.
In the event you become bankrupt, commit fraud, misrepresent any information, violate any Terms and Conditions, abuse your Program privileges or act in any other way to our detriment, as well those to our Partners, suppliers or the Program, we may, without affecting our other rights, disclose such information requested by proper authorities, terminate your enrollment and/or cancel your Membership. If any Freebees TM money expires or any good or service is cancelled for any reason, it becomes void without compensation to you.
These Terms and Conditions constitute the entire agreement between you and us regarding your participation in the Program, your entitlement to accumulate and spend Freebees TM money, and your entitlement to any other benefits of the Program, and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with us over the Internet, you consent to the formation of contractual relations through electronic communications. We are the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program.
We will not be taken to have waived any of our rights even if we redeem Freebees TM money when not required. The Program, all rules and Terms and Conditions are governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable, and should be considered as a contract governed by the laws of the Province of Quebec, without regard to or application of its conflict of law provisions or your state, province or country of residence. If any provision of these Terms and Conditions is invalid or unenforceable, such provision shall not affect the validity and enforceability of the remaining Terms and Conditions.
Without prejudice to our ability to enforce the Terms and Conditions in any other proper jurisdiction, all claims, legal proceedings or litigation arising in connection with the Program will be brought solely in the Quebec Court in the Province of Quebec, Gatineau district, or the Federal Court located in the Province of Quebec. You consent to the jurisdiction of and venue in such Courts and waive any objection as to inconvenient forum that it may now or hereafter have to the venue of any legal proceeding arising out of or relating to the Terms and Conditions. Any decision in any proceedings relating to the Program shall be final.
VIII. SECURITY
We take reasonable steps to protect your personal data downloaded via our Internet website or the mobile application from any loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no Internet, email, mobile or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you provide.
We need your help to keep Freebees safe, which includes the following commitments by you:
- You will not collect users' content or information, or otherwise access Freebees, using automated means (such as robots, spiders, etc.) without our prior permission.
- You will not upload viruses or other malicious code.
- You will not solicit login information or access an account belonging to someone else.
- You will not use the site to bully, intimidate, or harass any user or to steal a person’s identity.
IX. WE RESPECT YOUR PRIVACY
We are committed to protecting your privacy. We collect and use your private information according to the standards as set out in our Privacy Policy.
The personal information of Members and Partners are considered assets of Superstar Communications. In the event our company is sold to a new owner, personal information will be transmitted and will be part of its assets.
